Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Arcade mobile application and related services (the “Service”) operated by Arcade Labs Inc. (“Arcade,” “we,” “us”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into these Terms. You may not use the Service if you are located in, or are a resident of, any jurisdiction where use of the Service is prohibited, or if you are subject to applicable sanctions. You are responsible for determining whether your use of the Service is lawful in your jurisdiction.
2. The Service
Arcade is a self-custodial interface for trading digital assets. You control your own wallet and assets. We do not take custody of your funds, do not hold your assets, and cannot execute transactions on your behalf without your authorization. We are not a bank, broker-dealer, exchange, custodian, or money transmitter, and we do not provide investment, financial, legal, or tax advice.
3. Assumption of risk
Trading digital assets involves substantial risk, including the risk of total loss. Prices are volatile. Blockchain transactions are generally irreversible. You are solely responsible for your trading decisions and for securing your credentials, device, and recovery methods. You accept all risks associated with using the Service and trading digital assets.
4. Third-party services
The Service integrates third-party providers, including authentication and wallet infrastructure (Privy), a fiat on-ramp (MoonPay), and blockchain networks and liquidity venues. Your use of those services may be subject to their own terms and policies. We are not responsible for the acts, omissions, or availability of third parties.
5. Acceptable use
You agree not to use the Service to violate any law; to engage in fraud, market manipulation, money laundering, or the financing of illicit activity; to infringe others' rights; to interfere with or attempt to compromise the integrity or security of the Service; or to circumvent any access controls or geographic restrictions.
6. Intellectual property
The Service, including its software, design, and trademarks, is owned by Arcade Labs Inc. or its licensors and is protected by applicable law. These Terms do not grant you any right to our intellectual property except the limited right to use the Service in accordance with these Terms.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCADE LABS INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, ASSETS, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
9. Indemnification
You agree to indemnify and hold harmless Arcade Labs Inc. from any claims, losses, and expenses arising out of your use of the Service or your violation of these Terms or applicable law.
10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where applicable law provides otherwise.
11. Changes
We may modify these Terms from time to time. Changes are effective when we post the updated Terms and revise the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance.
